'Hitman: Absolution' trademarked by Square Enix

'Hitman: Absolution' trademarked by Square Enix Japanese publisher's UK arm files European application to lock down rights for title--is it the name of Hitman 5?   Will Agent 47 find absolution in the new Hitman game? Ever since Hitman: Blood Money was released in 2006, the popular stealth-action series has lain fallow. There have been rumors of a fifth installment in the series, with one report having Batman: Arkham Asylum maker Rocksteady Studios taking over development of the series from franchise creator IO Interactive. More recently, though, an apparent alternate reality game has been offering teaser images that point to an imminent reveal of a new Hitman title. Today came another indicator that a new installment in the Hitman saga is in the works. Square Enix has filed a trademark application (spotted by Siliconera) for the term "Hitman: Absolution" with the trademark registry for the European Union. The filing was done through Square Enix's British arm, formerly known as Eidos Interactive before the publisher was bought and absorbed by the Japanese company in 2009. The Hitman ARG has reportedly been teasing images of the new game. The Hitman series follows the murderous exploits of Agent 47, a bald killer genetically engineered to be the perfect assassin. Hitman: Codename 47 (2000) told the tale of how the protagonist found work with the International Contract Agency (ICA) whacking high-profile criminals. Hitman 2: Silent Assassin (2002) sees 47 pulled out of retirement after his priest friend is kidnapped by the Sicilian mafia. In Hitman: Contracts (2004), he revisits many missions from the original game, albeit in reverse. PS3 Child of Eden due in Sept.

PS3 Child of Eden due in Sept. Tetsuya Mizuguchi's latest psychedelic on-rails rhythm shooter set to arrive on Sony's system months after Xbox 360 edition's June 14 debut.   Last month, Ubisoft confirmed a June 14 launch date for the Xbox 360 version of Child of Eden, with its PlayStation 3 sibling set to arrive at a nebulous later date. The publisher has narrowed that window down a bit, today announcing that the PS3 edition of Child of Eden is expected to launch sometime this September. Sure it's cute now, but wait until it turns into Adolescent of Eden. Developed by Tetsuya Mizuguchi's Q Entertainment, Child of Eden is largely in keeping with the developer's previous work. The game takes its cues in large part from Mizuguchi's acclaimed rhythm shooter Rez, and it features the same style of music-enhanced shooter gameplay with psychedelic visuals. It also bears a storyline: Gamers will attempt to rescue the embattled Project Lumi, which is an effort to "reproduce a human personality inside Eden, the archive of all human memories." A virus has invaded the program, however, and players must defeat it, before all hope is lost. The game's visual style approximates a virtual reality universe and is heavily reliant on geometric shapes in motion against an ever-shifting background. Stacking First Look

Double Fine's upcoming downloadable title reveals the secret life of Russian nesting dolls. Stacking is the upcoming game from Tim Schafer’s Double Fine Productions that continues the San Francisco based developer’s experimentation with creating smaller games for digital distribution. As with Double Fine’s first downloadable game, Costume Quest, Stacking is being helmed by another rising star in the company, Lee Petty who last served as art director on Brutal Legend. Schafer and Petty recently dropped by our offices to show off the unique game inspired by Russian nesting dolls. Although the dolls from the late 1800’s may sound like an unlikely muse that isn’t necessarily a great fit for a game, Stacking will surprise you. [ Watch Video ] Comment on this videoWatch this video in High Def Stacking was born out of a creative exercise at Double Fine where the company splits into four small teams that quickly prototype ideas into playable demos that could become full fledged games. In the case of Stacking, Petty found himself inspired as he watched his daughter play with a set of nesting dolls. The notion of each of the dolls fitting into each other sparked an idea for a gameplay mechanic that wound up being prototyped by the team Petty headed up. Once the concept was green lit, Petty began researching both the history of stacking dolls as well as the era they emerged from for story and gameplay ideas. Given the artistic streak of both Petty and his team, Stacking has morphed into a Victorian-era art flavored hybrid of adventure and puzzle games that revolves around a young nesting doll named Charlie out to rescue his family. Stacking’s story will unfold via silent film style cinematics, which will add up to over 2 hours of narrative, that flicker dramatically as text cards pop up. The story finds Charlie’s happy home broken up by an evil Baron who sends the whole brood into the lively indentured service industry. Charlie, left behind due to his small size, sets out to find and rescue his family using his wits and unique ability to possess other dolls by jumping into them. We had the game demoed for us as both Petty and Schafer talked us through the mechanics and systems on display. The work-in-progress demo we were checking out on the Xbox 360 kicked off with the set-up of Charlie’s family being split by the evil Baron and the tiny doll setting to save the day. As any first time hero will tell you, heading out to save the day is a little tricky your first time out of the gate but Charlie lucks into a meeting with Levi the hobo, a young drifter who’s hanging around the train station where the adventure begins. Our demo showed off two areas: the train station which serves as a hub, as you’ll be travelling to different locations to collect all your family; and a cruise ship, one of the locations you’ll explore. Each area will feature different missions for you that will consist of puzzles to solve. Stacking’s puzzle-solving mechanic is an interesting spin on old school adventure games. Charlie’s primary ability is to hop in any doll that’s one size larger and that has its back turned to him. Once Charlie is in the doll he’ll have access to its unique action or ability. Figuring out which abilities to use and what order to use them in on either the environment or other characters you encounter offers a good mental work out. For example, we saw Charlie needed to board a train to get to where one of his family members was being held. Unfortunately a train strike had sent three striking workers to go grouse about their situation at an exclusive lounge Charlie couldn’t access. In order to complete the mission Charlie needed to get the workers out of the lounge and basically create a stacked set of all three of the workers. While many of the traditional adventure games that Stacking owes a tip of the hat to would only have a single solution, the game features several different solutions to a given problem. The solutions to the lounge problem actually came out to three ranging from traditional to unorthodox. The key to all the solutions lay in finding the different ways in which Charlie could use the other dolls around him. For example, using one doll players would be able to flirt with a guard who would shift his position and allow Charlie to possess him, another option actually allowed Charlie to possess a doll that could fart into the lounge’s ventilation system and flush everyone out, while the last option let Charlie use a doll’s mechanical prowess to open the covering into the lounge ventilation system. When players complete a mission, they’ll see a counter showing them how many other options exist to solve it so they can try to discover them all. While the train lounge was a pretty simple mission to tend to, the cruise ship offered a much larger environment to interact with and a broader array of puzzles to contend with. While the core mechanics didn’t appear to offer any new functionality, the puzzles and options for solving them grew in complexity. The cruise ship challenges were more complex than the initial missions in the game and required smart navigation of the ship and use of possessed dolls. In this particular mission Charlie’s main task was to help a mutiny along, but a number of side quests were available as well. Managing what quest you take on first and trying to figure out how to effectively use all the unique doll abilities kept things interesting in our demo and left us excited to see later levels. One point to definitely call out about our demo was the strategic use of doll possessing. Besides offering you unique abilities to try to solve in a quest, possessing other dolls lets you build up a personal collection you can review in the game’s pause menu. Collecting whole sets yields bonuses to encourage players to keep their eyes peeled. The mechanic looks interesting and we expect challenging when dealing with dolls of varying sizes above Charlie. The game’s presentation makes some unique choices that give the game a fresh sense of style. The art direction is a sly, adventurous mix of old timey black and white presentation with more colorful Victorian flourishes. The objects in the world also have a distinct look to them thanks to the team drawing inspiration from tilt-shift photography. Charlie and the residents of his world fit the scale of their surroundings without beating you over the head with it. While this may sound a little odd on paper, once you see the game in motion it all makes sense. The game’s color palette offers a muted, almost sepia tinge to the environments we’ve seen so far that gives the game a unique look that fits everything nicely. The game’s audio takes a minimalist approach, using sound effects but no voice. However this doesn’t mean Stacking is lacking in the sound department. The game draws on a nice mix of classical pieces of music from Chopin, Mendelssohn, and Tchaikovsky as well as original material from Peter McConnell that all suit the unique world. Based on what we’ve seen so far, Stacking is looking like a smart, fun fresh spin on the traditional adventure game experience. The gameplay appears to offer players a flexible toolkit for problem solving that puts most of the pressure on a player’s brains rather than twitch reflexes. The art and story are creative and whimsical, which play to Double Fine’s strengths, so we’re anxious to see more of the game. Stacking is slated to release early next year for PlayStation Network and Xbox Live Arcade. Look for more soon. Rock Band developer sold off by Viacom

Harmonix bought up by private holding company; says "unannounced projects" are on the way.   A month and a half ago, media giant Viacom announced its intention to sell off Harmonix, developer of the Rock Band games. Today, the company announced the deal is done, with Harmonix-SBE Holdings LLC scooping up the studio for an undisclosed sum. The privately funded holding company is an affiliate of New York city-based investment firm Columbus Nova, LLC. Harmonix is dancing to the beat of a new drummer. In a forum post, Harmonix issued a statement in which it assured Rock Band owners that the sale won't affect the regular downloadable content updates for its games, which also includes Kinect favorite Dance Central. "We're excited to be returning to our roots as an independent and privately owned studio," read the post. "As for what it means for you, the DLC schedule marches on for Rock Band, we will continue our support of previously released titles, and we're hard at work on some unannounced projects that we think you're going to be pumped about." Harmonix also thanked Viacom and its subsidiary MTV Networks for being an "amazing home" since the studio was bought in 2006 for $175 million. The timing of the graciousness was curious, as just last week the original shareholders of Harmonix filed suit against Viacom, accusing the company of manipulating costs in order to deny performance bonus payments to Harmonix. Def Jam Rapstar adds Kinect, drops price

Rap-themed karaoke title now lets users record videos using Microsoft's motion-sensing camera; standalone MSRP now $40.   Konami's Def Jam Rapstar launched in early October sandwiched between two music-themed industry heavyweights Guitar Hero Warriors of Rock and Rock Band 3. The rap-themed music entry won a cool critical reception, and volleys of new songs have been made available for the title since launch. Now, two new updates have arrived for the game. Def Jam Rapstar added Kinect support with a new patch. Konami sent word today that a patch is now live for the Xbox 360 version of the title that brings Kinect support to the title. Using the tech's camera, gamers will be able to record videos of themselves and upload them to the community. The other bit of news Konami dropped today was that Def Jam Rapstar's new MSRP has dropped to $40 for the standalone product (Wii, Xbox 360, PlayStation 3). It appears as if the $70 bundled controller version of the title would also see a price drop. Amazon and GameStop are currently selling the microphone-bundled versions at $50. Judge certifies EA football class-action suit

Court gives gamers the go-ahead to join litigation surrounding alleged anticompetitive practices by Madden NFL publisher since January 1, 2005.   One thing's for sure: Electronic Arts' legal department won't be getting a lighter work load for Christmas. One day after the publisher was slapped with a $400 million lawsuit stemming from its alleged involvement in the firings of Infinity Ward heads Jason West and Vince Zampella, US District Court Judge Vaughn R. Walker certified a national class-action lawsuit against EA's Madden NFL, NCAA Football, and Arena Football licenses, which was originally filed in June 2008. EA's having a rough run on the legal gridiron. As a result of today's ruling, gamers who bought Madden NFL, NCAA Football, or Arena Football games published by EA after January 1, 2005 can join the lawsuit as plaintiffs. Gamers can join the suit through law firm Hagens Berman's Web site. "Consumers now have a legal standing to demand that EA refund consumers millions of dollars it made from Madden NFL and other sports titles through what we contend was an illegal price-gouging scheme," said Steve Berman, managing partner of Hagens Berman. "We're gratified by the ruling, and believe it underscores how lucrative and exclusive agreements in the video game industry can come with an inflated price tag for consumers." The suit, which was filed by Hagens Berman on behalf of a pair of gamers from Washington, DC, and California, alleged that EA has and continues to engage in "blatantly anticompetitive conduct" since 2004. At that time, EA and Take-Two Interactive released competing NFL Football products, resulting in a pricing war that saw Take-Two drop the price of its NFL 2K5 to $19.99 and EA cut Madden 2005's sticker tag to $29.95 in response. However, the suit alleged that rather than continue the pricing war with Take-Two, EA secured the exclusivity deals with the NFL, NCAA, and Arena football leagues. With no Take-Two competitor the following year, the suit noted that Electronic Arts raised the price of Madden 2006 back to $49.95, an increase of nearly 70 percent. Madden NFL's current going rate retails for as much as $59.95. "We believe EA forced consumers to pay an artificial premium on Madden NFL video games" Berman continued. "We intend to prove that EA could inflate prices on their sports titles because these exclusive licenses restrained trade and competition for interactive sports software." Madden NFL remains one of EA's best-selling titles, according to the NPD Group. In November, the most recent edition of the game, Madden NFL 11, ranked fourth in US retail sales, having seen release on the Xbox 360, PlayStation 3, PlayStation 2, PSP, and Wii. Castlevania: Lords of Shadow DLC detailed

Reverie and Resurrection set for launch in February and April; add-ons will introduce new locations and monsters, flesh out game's story and epilogue.   The ending of October's Castlevania: Lords of Shadow suggests a new direction for Konami's gothic action franchise, and gamers may soon get a peek at what else the publisher has in store for the Belmont saga. Konami today detailed its first downloadable content for Lords of Shadow, saying it would launch a pair of add-ons early next year. Reverie and Resurrection will give players more insight into Lords of Shadow's storyline. The first add-on, Reverie, sees players in the guise of Gabriel Belmont again, dealing with the consequences of slaying the vampire queen Carmilla. While Carmilla is gone, an evil she had previously kept under control has been unleashed and needs to be dealt with in the DLC. The second add-on, Resurrection, takes place immediately after the end of Lords of Shadow. Konami has said the DLC will be larger in scope than Reverie, featuring a climactic battle with "a very notorious enemy" that will shed light on the original game's ending. Developed by Spain-based Mercury Steam under Metal Gear creator Hideo Kojima's supervision, Lords of Shadow is set in the year 1047 and follows Gabriel Belmont as he pursues pieces of an artifact that can bring the dead back to life, while battling nefarious underworld creatures and other mythical monsters. The game represents a departure for the series, emphasizing puzzles as well as action gameplay in a 3D environment. Dungeons & Dragons Daggerdale going downloadable

Atari readies new multiplayer action RPG for spring 2011 release; Xbox 360, PS3, PC versions announced. The Dungeons & Dragons license has been dormant on consoles this generation, but Atari is readying a wake-up call for the venerable role-playing franchise. The publisher today announced Dungeons & Dragons Daggerdale, a new downloadable game for the Xbox 360, PlayStation 3, and PC. Atari unsheathes Daggerdale next year. Set for release in spring 2011, Daggerdale is an action role-playing game that has players trying to thwart the nefarious designs of Rezlus to save the Dalelands. Described by Atari as an action RPG with "pick-up-and-play combat," Daggerdale will let gamers go it alone or travel in multiplayer parties of up to four. The game marks this generation's console debut for Dungeons & Dragons. While Atari has been busy on the PC front with the Neverwinter Nights series and Dungeons & Dragons Online: Stormreach, console fans have received little attention since Stormfront Studios' 2004 entry Forgotten Realms: Demon Stone. The series has been slightly more visible on the go, with 2007 seeing the launch of Dungeons & Dragons Tactics for the PSP. Daggerdale is being developed by Toronto-based Bedlam Games. The studio was previously announced as working on Scratch: The Ultimate DJ after the game's original developer, 7 Studios, was acquired by Activision. EA opening Portal 2

Publisher's EA Partners program will handle retail distribution for Valve's forthcoming Mac, PS3, 360, PC puzzler.   When Portal debuted in 2007, it came as part of The Orange Box, a compilation of several hit games from developer Valve Software. The collection, which also included Half-Life 2 and Team Fortress 2, was distributed by Electronic Arts under its EA Partners program, which offers independent developers a suite of publishing services to choose from. EA Partners will open up Portal 2 at retailers. When Portal 2 was confirmed in March, there was no doubt that the game would be distributed online via Valve's Steam network. However, there was some question about who would handle the boxed copies of the game, which ships in North America on April 20 for the Mac, PC, PlayStation 3, and Xbox 360. Now, though, EA has confirmed that Valve has re-enlisted with EA Partners for distribution of Portal 2 at retail. Portal 2 follows the events of the first Portal, which saw gamers taking on the role of a human lab rat, Chell, who used a portal gun to create interdimensional openings on ceilings, walls, and floors in an effort to escape the Aperture Science labs. Along the way, players were guided through the diabolical tests by the deceptively sincere, yet altogether sadistic, artificial intelligence known as GLaDOS. The game will feature a single-player campaign billed as being twice as long as the original's, but the real focus is on the new multiplayer cooperative mode. The co-op mode will tell a parallel story to the single-player adventure and last roughly as long. In it, players will take control of two robots, named simply Blue and Orange, and work together to tackle their own set of portal-related problems. Activision going after EA in West-Zampella suit, seeking $400 million

Publisher believes rival company induced Infinity Ward co-founders to break contracts during development of Call of Duty: Modern Warfare 2, asks to file amended complaint in existing court case.   Perhaps the biggest news of 2010 was Activision's firing of Infinity Ward heads Jason West and Vince Zampella, even after the pair helped produce the blockbuster hit Call of Duty: Modern Warfare 2. Those terminations led to an ongoing saga that saw mass defections from developer Infinity Ward, the creation of West and Zampella's new studio Respawn Entertainment, and a volley of litigation between the pair, Activision, and current and former Infinity Ward employees. Activision is taking aim at a new target in the West-Zampella suit. As 2010 draws to a close, the story is receiving one more plot twist. Activision today told GameSpot it asked a federal judge for permission to file an amended cross-complaint in its legal spat with West and Zampella. In addition to expanding on its claims against the pair, Activision wants to make Electronic Arts a defendant in the case. According to a copy of the filing provided by the Call of Duty publisher, Electronic Arts tampered with West and Zampella, inducing the pair to break their existing contracts with Activision, freeing them to establish Respawn and sign with the EA Partners program. According to the filing, "Starting as early as July 30, 2009, Electronic Arts and [West and Zampella]--with full knowledge that the executives were under contract and legally committed to Activision for more than two additional years--conspired to set up an independent company." It continued, "The unlawful conduct came from the highest levels at Electronic Arts, including EA Chief Executive Officer, John Riccitiello, and Chief Operating Officer, John Schappert, with direct support from the high profile talent agency, Creative Artists Agency, and even a former member of Activision's Board of Directors and former Activision lawyer." The cross-complaint, which EA declined to comment on, alleged a number of shady dealings between EA execs and West and Zampella. Specifically, it referenced an e-mail exchange between West and Schappert, in which the EA COO said he was thrilled to have a "super secret way into Jason." As a result of the exchange, brokered by CAA agent Seamus Blackley, West and Zampella were flown to Riccitiello's home by private jet on August 28, 2009 for a meeting with the CEO. The pair later admitted that at said meeting, they told the executive that they had over two years remaining on their contract with Activision. The suit further focused on Harold Brown, a former board member of Activision and attorney who represented West and Zampella at the behest of CAA. A scan of an e-mail purportedly from Blackley to Zampella read, "[Brown] was the one I mentioned in the context of taking a look at your deal as a sanity check. So I mentioned to him that there might be a big developer who'd want someone good to take a look at an agreement, wink wink, and he was VERY INTERESTED." (Emphasis in the original.) The e-mail is dated August 19, 2009. The suit notes that Brown would have had prior knowledge of Activision's incentive practices and suggests CAA brought him in to cloak negotiations with EA under an attorney-client privilege. The only direct tie alleged between Brown and EA in the non-redacted sections of the filing is that the former was a law school classmate of an EA executive. In the cross-complaint, Activision is seeking $400 million in actual and punitive damages from EA, West, and Zampella, "including profits Activision would have made but for EA's interference, costs incurred in rebuilding the affected studio, and damages suffered as a result of delays and disruptions." Activision also hopes "to recapture compensation previously awarded to its faithless executives," to unseal a number of documents that have been deemed confidential, and to prevent EA, West, and Zampella from benefiting from their allegedly illegal conduct. It is unclear if the formation and operation of Respawn would count as "benefiting." Though this is Activision's first attempt to include its rival in the suit, Electronic Arts has been alluded to essentially from the dispute's beginning. In Activision's original countersuit against West and Zampella, the publisher accused the two of embarking "on a secret trip by private jet to Northern California, arranged by their Hollywood agent, to meet with the most senior executives of Activision's closest competitor." [UPDATE] The new suit goes on to allege that as a result of their negotiations with EA, West and Zampella began to act "in a manner that was in breach of their contractual and fiduciary obligations to Activision." This behavior allegedly includes providing "confidential and proprietary Activision information" to Electronic Arts, as had been alleged in Activision's prior countersuit. The suit contends that "West and Zampella made exceedingly aggressive demands to Activision to enrich themselves at the expense of Activision's shareholders, including that they be permitted to 'spin out' from Activision, set up their own independent company and produce games on terms that were far less favorable to Activision than the terms of West's and Zampella's existing exclusive employment agreements that…had years left to run and for which they received tens of millions of compensation." If true, one example of insubordinate behavior may come as a shock to Infinity Ward employees past and present. The suit alleges that "West and Zampella…s self-interest in executing their secret plan to leave Activision corrupted their judgment so fully that they actually attempted to damage the very Infinity Ward employees they purported to lead. In July 2009, West and Zampella were asked by Activision management to provide the names of the Infinity Ward employees that should receive millions of dollars of Activision stock grants in connection with the development of a Wii version of Call of Duty 4: Modern Warfare. West and Zampella adamantly refused." The complaint continues, "Again, in October 2009, when Activision planned to include Infinity Ward in its annual equity grants, West and Zampella refused to provide Activision with a list of the names it needed of the Infinity Ward employees that deserved awards of valuable stock and options. In responding to the President and CEO of Activision Publishing concerning the equity grant, West wrote, 'You can give all the options to Vince and I . . . .,' thereby depriving their own Infinity Ward employees of additional compensation." Windows Phone 7 sells 1.5 million in 6 weeks

Microsoft's mobile operating system hits platinum-and-a-half milestone as company emphasizes a "long run" strategy.   Microsoft's Windows Phone 7 has been on the market since November 8 in North America, and it appears as if the device is off to, if not a spectacular, at least respectable start. Today, Microsoft announced that Windows Phone 7 devices sold-in more than 1.5 million units within six weeks. However, the Redmond, Washington-based company did not indicate how many units had been sold through to consumers. 1.5 million units in six weeks is a good start, says Microsoft. As part of an internal interview, Microsoft vice president of business and marketing for Windows Phones Achim Berg emphasized that the company's goal for success in the mobile market is not predicated on short-term sales milestones. He also noted that comparing Windows Phone 7 sales to the competition would be an "apples-to-oranges" effort. "Our numbers are similar to the performance of other first generation mobile platforms," he said. "We introduced a new platform with Windows Phone 7, and when you do that it takes time to educate partners and consumers on what you're delivering, and drive awareness and interest in your new offering. We're comfortable with where we are, and we are here for the long run; Windows Phone 7 is just the beginning." Windows Phone 7 is currently available on four smartphones in the US: the HTC Surround, Samsung Focus, HTC HD7, and Dell Venue Pro. Microsoft is also cross-promoting Windows Phone 7 with its Xbox brand, beyond the operating system's Xbox Live compatibility. Call of Duty: Black Ops tops $1 billion

Activision's shooter hits worldwide revenue milestone in less than two months; more than 600 million hours of play logged.   Call of Duty: Black Ops continues to mark off milestones, as Activision today announced that the Treyarch first-person shooter has reaped $1 billion in revenues since its November 9 debut. According to the publisher, "in all of entertainment," only James Cameron's blockbuster film Avatar has managed to break the billion-dollar mark that quickly. With $1 billion in the bank, Black Ops . It helped that Black Ops got off to a fast start. In the first 24 hours, 5.6 million gamers answered the latest Call of Duty for a total of $360 million in sales. Within the first five days, Black Ops sales had reached $650 million. Those numbers trumped last year's opening for Call of Duty: Modern Warfare 2, which posted a 4.7 million unit, $310 million one-day total and reached $550 million in five days. Naturally, people aren't just buying the game; they're also playing it in abundance. Activision claimed players have spent more than 600 million hours with Black Ops. The publisher cited statistics from Microsoft that the average player logs on to the game more than once a day, with each session lasting more than an hour. Rock Band developer's founders suing Viacom

Alex Rigopulos and Eran Egozy among Harmonix ex-shareholders who claim multimedia giant manipulated costs to prevent bonus payouts.   This year began with media giant Viacom revealing it was seeking a "substantial" refund of the $150 million in bonuses it paid to the shareholders of Harmonix, developer of the Rock Band games. Now, 2010 is ending with Harmonix filing suit against its soon-to-be-former owner, claiming it manipulated costs to evade payments due to the studio's shareholders under a profit earn-out agreement. Harmonix's founders are suing their employer. According to a copy of the complaint obtained by industry site Gamasutra, a group of the initial shareholders in Harmonix, including cofounders Alex Rigopulos and Eran Egozy, accuse Viacom of manipulating the earn-out payments by "diverting opportunities from Harmonix for its own benefit." Among those opportunities was a chance to renegotiate fees with Electronic Arts, which distributes the Rock Band games. Instead of reducing the fees--and thereby increasing profits, which would lead to larger earn-out payments for Harmonix--Viacom allegedly arranged for EA to buy millions of dollars' worth of ads on Viacom's various networks in 2008. The suit contends that the EA/Viacom deal would then reduce EA's distribution fees in 2009, after Harmonix's earn-out period had expired. According to the suit, "Although a reduced 2008 EA distribution fee would have increased Harmonix's gross profit and operating profits in 2008, Viacom realized that every $1.00 of distribution fees that Harmonix saved during 2008 would require Viacom to pay an additional $3.50 of earn-outs to the [ex-shareholders]." Saying that Viacom's actions have "damaged" the former shareholders, Harmonix is asking for the equivalent of the earn-out payments it would've received had the EA fees been reduced in 2008. Professional gaming circuit lands large investment from Legion Enterprises; league's website boasts 4.5 million monthly users; Pro Circuit weekend events grabs 600k viewers.   Some gamers enjoy playing titles at their own pace, with minimal outside pressure to perform. But there's also a competitive slice of the gaming pie for those who strive for dominance. Now, a professional league for the latter group has more money to play with. One of the world's most prominent professional gaming league, Major League Gaming, has announced it has struck an agreement to land $10 million in funding capital, scheduled to arrive in the league's coffers by Q1 2011. MLG is now $10 million richer. The investment initiative was led by Legion Enterprises, an investment firm that "invests in, acquires, and develops companies that create digital products appealing to the 16-24 year old male demographic of digital mavericks." The additional investment brings MLG's funding total to $52.5 million. "Over the last eight years we have set out to build competitive gaming into a global, cross-platform business," said Sundance DiGiovanni, MLG's CEO. "And thanks to investments from companies like Legion Enterprises and Oak Investment Partners, that vision is well on its way to becoming a reality." Additionally MLG claims it now reaches almost 4.5 million monthly users via its newly redesigned website, and draws an average of 600,000 viewers during its Pro Circuit weekend events. 'Madden Curse' movie in the works - Report

EA developing sports comedy which will focus on perceived hex associated with cover-athlete honor.   For years, people have talked about the "Madden Curse" which sees cover athletes for Madden NFL series suffer injuries or misfortune. Now publisher Electronic Arts is apparently looking to turn the Madden curse into a major motion picture. The Madden Curse may be going Hollywood. According to Hollywood trade The Wrap, EA is developing a sports comedy about an athlete who, like Brett Favre did in 2008, gets the Madden cover honor after he retires--but then comes out of retirement. Pat O'Brien, vice president of EA Entertainment, is apparently leading the development effort for the project, which is in its early stages. Perceived or real, the Madden Curse has been eerily consistent. In 2009, Madden NFL 10 co-cover star Troy Polamalu suffered a knee injury in the second quarter of the season opener. After a string of injuries, 2007 cover star Shaun Alexander went from the NFL's Most Valuable Player to being a backup running back in just two years. The list goes on: Madden NFL 06 cover athlete Donovan McNabb suffered a season-ending hernia halfway through the year. Finally, 2004 cover athlete Michael Vick missed most of the subsequent season due to a major leg injury--before he was suspended due to involvement in gambling and dog-fighting crimes several years later. Current cover athlete Drew Brees has remained unscathed this season--so far, anyway.
